Terms of use

General terms and conditions for ReportNow!. Version 1.1, as at 14 October 2026.

This is a translation for your information; only the German version is binding. Prices, booked quantity, term, cancellation, invoicing and payment are set out in the contract terms you see and accept in ReportNow! under My account › Billing when you conclude the contract; the pricing page explains them. Data protection is governed by the data processing agreement. Please send any questions to info@reportnow.de.

Section 1 Scope and order of precedence

These terms of use apply to the use of ReportNow! (hereinafter the “application”), which LittVest GmbH, Hallesche Str. 5a, 10963 Berlin, Germany (hereinafter the “provider”) makes available over the internet – during the free trial and under a paid contract.

The application is intended exclusively for entrepreneurs within the meaning of Section 14 German Civil Code (BGB), legal entities under public law and special funds under public law (hereinafter the “customer”). No contract is concluded with consumers.

The customer’s general terms and conditions do not apply, even if the provider does not expressly object to them.

In the event of conflict, the following order applies: (1) the contract terms the customer accepts on conclusion in the application (prices, booked quantity, term, cancellation, invoicing and payment), (2) in matters of data protection, the data processing agreement under Art. 28 GDPR (hereinafter the “DPA”), (3) these terms of use.

Section 2 Conclusion of contract

The presentation of the application on reportnow.de is not a binding offer.

The free trial is concluded when the customer registers an account on reportnow.de and confirms the registration via the link in the confirmation email. On confirmation the provider creates the customer’s tenant and account.

The paid contract is concluded when a tenant administrator of the customer concludes it in the application under My account › Billing. The provider confirms the conclusion by email to the address of the account used to conclude it.

Anyone who registers, concludes or cancels a contract, or concludes the DPA on behalf of the customer warrants that they are authorised to do so. These declarations are attributed to the customer.

Section 3 Free trial

The free trial lasts 14 days including the day of confirmation and is free of charge. The provider does not ask for payment details. It may extend the trial; there is no entitlement to an extension.

The free trial ends by itself without notice of termination; it does not turn into a paid contract automatically. After it ends, the tenant is locked until the customer concludes a contract. If no contract is concluded, the provider deletes the tenant’s account and data no later than 30 days after the end of the trial.

The free trial counts as the usage contract within the meaning of the DPA. During the free trial, notwithstanding Section 12, the provider is liable only for intent and gross negligence and under Section 12 (3).

Section 4 Services of the provider

The provider makes the application available as software for use over the internet (software as a service) – for importing accounting, payroll, sales, bank and contract data, analysing and planning them, presenting them in reports and exporting them. The functions the application offers when the contract is concluded are decisive.

The application runs on servers in the European Union. The customer needs an up-to-date web browser and internet access; neither is part of the service.

The provider develops the application further. It may change, replace or discontinue functions provided this does not significantly impair the use presupposed by the contract. Functions described as planned or in preparation do not give rise to any entitlement.

The provider answers questions about using the application by email to info@reportnow.de on working days within a reasonable time. Further services, such as setting up reports, training or preparing source data, are agreed separately.

Section 5 Availability and maintenance

Under a paid contract the application is available 98 % of the time on average over a calendar month, measured at the exit of the data centre. Maintenance within the meaning of the following paragraph and interruptions for which the provider is not responsible, such as internet outages outside its sphere of control or force majeure, do not count as downtime. No particular availability applies during the free trial.

The provider may briefly interrupt the application for maintenance and for installing new versions, usually for a few seconds to minutes; where possible it schedules such work outside normal business hours. It announces maintenance of more than 30 minutes by email in advance.

Section 6 Accounts and access data

The tenant administrator invites further people and sets their permissions. Each account is personal and must not be shared by several people. Users within the meaning of the contract terms are all accounts with access to the tenant except the provider’s own – including accounts of advisers or companies the customer invites.

The customer keeps passwords secret, ensures that its users comply with these terms and is responsible for their actions in the application. If it suspects that unauthorised persons know access data, it changes the password and informs the provider without delay.

The provider reads the tenant’s content through the application only if the customer grants it time-limited access under Master data › Operator view, or to the extent the DPA permits.

Section 7 Obligations of the customer

The customer only brings in data it is permitted to process and is responsible for their accuracy and completeness. It keeps the source files it imports itself; the application replaces neither its bookkeeping nor the retention of its records.

In particular, the customer refrains from

  • uploading malware or files that may disrupt the application,
  • querying the application automatically beyond normal use or circumventing its safeguards,
  • making the application available to third parties other than its users or operating it as its own service for third parties,
  • modifying, decompiling or reverse engineering the software except as permitted by law (Section 69e German Copyright Act).

If the customer seriously breaches these obligations, the provider may temporarily lock access to the extent necessary to prevent damage. It informs the customer without delay.

Section 8 Calculations, checks and AI texts

The application calculates from the data and settings the customer brings in. It shows plausibility checks – such as the balance sheet and cash flow checks or unassigned accounts. These checks show what does not add up; they do not rule out errors in the source data, the setup or the analysis.

Reports, plans and analyses are aids for the customer’s decisions. They do not replace the customer’s own review, annual financial statements or tax, legal or investment advice. Plans are based on the customer’s assumptions; their occurrence is not owed.

Texts written by a language model (report commentary, management report, in-app help) are only produced if the customer has enabled this function. The application checks the figures they contain against its own calculation, but not every statement. The customer reviews such texts before using them.

Section 9 Rights of use and customer data

For the term of the contract the provider grants the customer the simple, non-transferable and non-sublicensable right to use the application for its own purposes and those of the companies in its tenant. All other rights in the application remain with the provider.

The data the customer brings in and the results it produces from them belong to the customer. It may use exports (PDF, Excel, CSV, PowerPoint, Word) without restriction. The provider processes the data only to provide the application, in accordance with the DPA.

The provider names the customer as a reference only with the customer’s express consent.

Section 10 Remuneration, default and set-off

Remuneration, invoicing and payment are governed by the contract terms the customer accepts on conclusion. The free trial is free of charge.

If the customer is more than 30 days in default with a payment, the provider may lock access after a reminder in text form setting a deadline of at least 14 days and announcing the lock, until the outstanding amount is paid. During the lock My account › Billing remains available; nothing is deleted. The obligation to pay remains unaffected.

The customer may only set off claims that are undisputed or have been finally established by a court.

Section 11 Defects

The customer reports defects without delay in text form, if possible with a description of how they appear, to info@reportnow.de. The provider remedies defects within a reasonable time; it may also provide a workaround if this is reasonable for the customer.

Strict liability for defects already present when the contract was concluded (Section 536a (1) first alternative BGB) is excluded. The right to reduce the fee and termination under Section 543 (2) sentence 1 no. 1 BGB remain unaffected; the latter only once the provider has failed to remedy a reported defect within a reasonable time.

Section 12 Liability

(1) The provider has unlimited liability for intent and gross negligence.

(2) In the case of slight negligence the provider is liable only for the breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely (material contractual obligation), and only for the typical damage foreseeable when the contract was concluded – per incident limited to the remuneration the customer has paid or owes for the twelve months before the damaging event.

(3) Liability for injury to life, body or health, liability under the German Product Liability Act, liability for fraudulently concealed defects and for an expressly assumed guarantee, and liability under Art. 82 GDPR remain unaffected.

(4) For loss of data the provider is liable only for the effort required to restore it from the provider’s backups or to re-import it from the customer’s source files.

(5) Otherwise liability is excluded. These rules also apply to the personal liability of the provider’s employees, representatives and vicarious agents.

Section 13 Confidentiality

Both parties treat confidential information of the other party that comes to their knowledge under the contract as confidential and use it only to perform the contract. This continues after the contract ends. Excluded is information that is publicly known or that a party must disclose by law or by order of an authority.

The provider obliges everyone who works on the application to maintain confidentiality. The DPA additionally applies to personal data.

Section 14 Term, termination and end of contract

Term, renewal and ordinary termination of the paid contract are governed by the contract terms; notice is given in the application under My account › Billing. The right of both parties to terminate for good cause remains unaffected; it requires text form.

The customer can export its reports itself at any time. On request the provider makes the complete data available in open formats, after the end of the contract within 30 days. It then deletes the data in accordance with Section 12 of the DPA.

Section 15 Changes to these terms

The provider may amend these terms with effect for the future if there is an objective reason, such as a change in the law, a new function or a gap that becomes apparent in operation. It does not change the main obligations or the prices in this way.

It announces changes by email at least 14 days before the cancellation deadline of the term from whose start they are to apply, naming the changed passages. If the customer does not cancel by that deadline, the amended terms apply from the start of that term; the provider points out this consequence in the announcement.

Section 16 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is the provider’s registered office if the customer is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany.

The contract language is German. A translation of these terms is for information only; the German version prevails.

If a provision is invalid, the rest of the contract remains valid. The invalid provision is replaced by the statutory provision.
